This agreement is between "you" the User of this Site and Albania Explorer Co. Ltd. The following terms and conditions govern your ("You" or "User") use of this Web site (the "Site"). The Site is owned and operated by Albania Explorer Co. Ltd, here after (Albania Explorer). Use of the Site is offered to the User conditioned on acceptance by the User without modification of the terms, conditions and notices contained herein. Use of the content, services, and/or products presented in any and all areas of these sites constitutes the User's agreement to abide by the following terms and conditions and those posted in specific areas of these sites. Albania Explorer may revoke Your ability to use the Site at any time and for any reason (or no reason). Albania Explorer may amend these terms and conditions at any time. All amended terms and conditions shall automatically be effective upon being posted by Albania Explorer to the Site. Accordingly, You should check the Site frequently for any changes to these Terms and Conditions. These Terms and Conditions may not be otherwise amended except in a writing signed by an authorized officer of Albania Explorer and You.

Products and Services
Albania Explorer Co. Ltd. is an Albanian Travel & Tourism Agency, which is licensed by Albanian Ministry of Tourism, Culture, Youth and Sports. Its products and services are all tourism related and are valid as per the dates and conditions as displayed on Albania Explorer Web site.

Our Responsibility
Tour members, acknowledge by their acceptance, that Albania Explorer, its agents and suppliers, in making arrangements for hotels, tours, transportation or any service in connection with the itineraries of individual tour members shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any hotel, carrier or other company or person providing services included in the tours. Further, Albania Explorer, its agents and suppliers accept no responsibility for any sickness, pilferage, labor disputes, machinery breakdown, government restrains, acts of war and terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control. Albania Explorer reserves the right to cancel, change or substitute any service and to decline to accept or retain any tour members at any time for any reason including, without limitation, insufficient number of participants.

Booking Arrangements
In all booking arrangements, the person making the booking shall be deemed to have accepted the booking conditions on behalf of the persons named in the booking. The contract will be governed by and subject to the Terms & Conditions. No variation to these Terms and Conditions shall be of any effect unless made in writing by and with the authority of Albania Explorer.

Payments
Credit cards accepted: Visa, MasterCard and American Express by fax authorization when you're not present in our office, and Debit Cards (which are Visa, Master, Visa Electron) through POS when you're showed up at our offices. Payments at exact agreed amount of service can also be done through bank transfer at given account number, and a copy of bank transaction will be faxed to us.

Children
Children under 5 years of age are carried free of charge providing they do not occupy a seat, otherwise the applicable child fare will apply. Any meals/admission fees are not included. Child fares are valid up to the age of 12. On multi-day tours children aged to 12 years will be charged at 50% of the applicable adult rate, provided that they share a room with two adults.

Correct Spelling of Names, Titles
All names, titles and initials of those traveling should be correctly given at the time of booking. Changes cannot be made at a later date.

Modifications/Amendments
All requests for modifications/amendments must be directed to the Albania Explorer Sales Officer who will implement the request.

CANCELLATIONS
Albania Explorer reserves the right to cancel any tour due to reasons outwith its control. In such cases the limit of the Albania Explorer's liability to the Agent or Consumers/clients is the return of any moneys paid by the Agent or Passenger for the element of the holiday booked by Albania Explorer. Where the Agent or Passenger cancels the tour reservation the effective date of cancellation will be the date on which the Albania Explorer receives written notification of the Agent or Passengers' intention to cancel their tour reservation. In the event of cancellation by the Agent or Consumers/client a cancellation charge calculated on the scale below shall become immediately payable by the Agent or Consumers/clients.

Cancellation Charges:
NOTE:
The Company reserves the right in its absolute discretion to refuse to carry any person whose conduct or manner causes or is likely to cause offence or upset to other Travelers. In such cases full cancellation charges will apply and the Company shall have no further liability to that Traveler.

Prices
Prices are per person, unless otherwise specified. Prices are in Euro. Price quotations are subject to change without notice until a booking has been confirmed.

Accuracy
We check and recheck facts about the product offered to ensure accuracy. When we are told in advance of a significant change to a booking, we notify the consumer/travel agent/distributor.

Accommodation
The hotels listed on each tour description will be used on most tours and packages. If a change is made for any reason, every effort will be made to ensure hotels used will be the equivalent of those shown. Please note that it is standard policy that hotel rooms are not available for check-in before 2.00 PM on the date of arrival.

Travel Insurance
We strongly recommend that, at the time of the booking, a comprehensive travel insurance policy be purchased.

Passports/Visas
It is the responsibility of all passengers, regardless of the passport they hold, to check with the appropriate consulates/embassies to determine if any visas are required. As visa and health requirements are subject to change without notice, it is recommended that verification prior to travel be made of existing foreign visa and health requirements. For latest visas practices and other border taxes related to Republic of Albania contact (Ministry of Foreign Affairs, and Ministry of Interiors) official web sides.

Baggage
Due to limited space on motorcoach tours, we ask tour members to carry one bag per person on each tour. Wheeled carry-on bags are not suitable as hand luggage on motorcoaches.

Force Majeure
Albania Explorer does not accept any liability for any loss, inconvenience or damage caused by war, threat of war riot or civil strife, terrorist activity, industrial disputes, natural disaster, fires, sickness, weather conditions, airport regulations, temporary, technical, mechanical or electrical breakdown of transport or any facilities contained within advertised accommodation, explosion of any nuclear plant or part thereof or radioactivity/ contamination arising from such plant or events beyond the reasonable control of the Albania Explorer.

Smoking
Smoking is not allowed on motorcoaches and in the non-smoking sections of trains, ferries, etc. Motorcoaches make regular stops for passengers who wish to smoke.

Modification Of These Terms And Conditions
Albania Explorer reserves the right to change the terms, conditions and notices under which this web site is offered as well as the contents of this web site. This right shall not affect the existing terms and conditions accepted by you upon making a legitimate reservation or purchase using this web site.

No Unlawful or Prohibited Use
As a condition of your use of this web site, you undertake to Albania Explorer that you will not use this web site for any purpose that is unlawful or prohibited by these terms, conditions and notices.

Disclaimer and Limitation of Liability
Albania Explorer may modify all tour itineraries, prices, dates, hotels, departures, destinations, and availability of the foregoing at any time without notice. Albania Explorer maximum liability at all circumstances with its consumers is equal with the amount of money of our service product as specified on this terms and conditions. Furthermore, Albania Explorer makes no warranty that any defects, whether known or unknown, will be corrected, or that the web site will be virus-free. Albania Explorer's liability is limited to the fullest extent permitted by law. Under no circumstances will Albania Explorer be liable under any section of these terms of use or under contract, negligence, strict liability or any other legal or equitable theory for any indirect, incidental, exemplary or consequential damages (including, without limitation, loss of use, lost profits, loss of data or information of any kind or loss of business goodwill or opportunity) whether or not Albania Explorer has been advised of the possibility of such loss or damages. Albania Explorer may at any time modify these Terms and Conditions and your continued use of this Site will be conditioned upon the Terms and Conditions in force at the time of your use. Any rights or obligations granted to You hereunder may not be assigned or transferred to any other person or to any entity.
